These Terms and Conditions apply to ServiceM8 setup, configuration, consulting, training and support services supplied by Anthill Technologies / TradiesHelp.au, ABN 67 869 707 435 ("Anthill Technologies", "TradiesHelp.au", "we", "us" or "our").
These Terms apply whether services are purchased or booked through the Anthill Technologies website, TradiesHelp.au website, TidyCal, quotation, invoice, payment link or another booking or payment method provided by us.
By accepting these Terms and proceeding with a booking or payment, you agree to enter into a binding agreement with us subject to these Terms and Conditions.
These Terms and Conditions form a legally binding contract between Anthill Technologies / TradiesHelp.au and the person, company, business or organisation purchasing the services ("Customer", "you" or "your").

By purchasing our ServiceM8 setup, consulting or training services, you are engaging Richard McIntosh, ServiceM8 Certified Gold Partner/Consultant, through Anthill Technologies / TradiesHelp.au.

BEFORE PURCHASING TRAINING, YOU MUST SATISFY YOURSELF THAT SERVICEM8 IS SUITABLE FOR YOUR BUSINESS.
It is your responsibility to investigate, evaluate and determine whether ServiceM8, the ServiceM8 app, its features, functions, subscription plans, integrations and device requirements are suitable for your business and intended use.
Anthill Technologies / TradiesHelp.au and Richard McIntosh provide setup assistance, consulting and training. We do not make the decision for you as to whether ServiceM8 is the correct software product for your business.
You are responsible for evaluating ServiceM8 in relation to your:
You should use ServiceM8's available free trial to investigate and evaluate the product before purchasing our training services.
DO NOT PURCHASE OUR TRAINING PROGRAM UNTIL YOU ARE SATISFIED THAT SERVICEM8 IS SUITABLE FOR YOUR BUSINESS.
ServiceM8 is an independent third-party software product. Anthill Technologies / TradiesHelp.au and Richard McIntosh do not own or control ServiceM8.
We cannot control changes made by ServiceM8 to its:
We do not guarantee that ServiceM8 will provide every function required by your business or that any particular feature or integration will remain available indefinitely.
When you purchase a ServiceM8 training package or block of training hours, you are committing to the training and consulting services purchased. You are expected to evaluate ServiceM8 before purchasing your training.
Once payment has been made, you cannot cancel your training program and request a refund merely because you subsequently:
A change of mind or personal preference does not entitle you to a refund.
ALL TRAINING PACKAGES, PREPAID TRAINING HOURS, SETUP AND CONSULTING SERVICES ARE NON-REFUNDABLE FOR CHANGE OF MIND.
Once payment has been made, a refund will not be provided merely because you:
Unused prepaid training hours have no cash redemption value.
This No Change-of-Mind Refund Policy does not exclude any refund, remedy or other right which you are legally entitled to receive under the Australian Consumer Law.
ServiceM8 setup and training is normally conducted progressively because properly implementing a business management system may require a number of stages. Customers may purchase a block of training hours and use those hours across multiple sessions.
We generally recommend:
Unless otherwise agreed, a training session may include up to three users from the Customer's business.
Training may be spread across a number of weeks or months as appropriate, subject to the training package purchased and any applicable ServiceM8 rebate deadlines.
Successful implementation of ServiceM8 requires active participation by the Customer. You are responsible for providing accurate information about your business, workflow, employees, systems and requirements.
You are responsible for reviewing and approving configuration decisions and ensuring that your:
is accurate and up to date.
If you, your employees, contractors, administrators or another person subsequently change settings, configurations, templates, permissions, integrations or other information following training, we are not responsible for problems caused by those changes.
You remain responsible for your business records, data, passwords, security, backups and ongoing use of ServiceM8.
ServiceM8 currently offers eligible new subscribers a Setup & Training Rebate in the form of ServiceM8 account credit, subject to ServiceM8's eligibility requirements and Terms and Conditions.
The rebate is offered, controlled and administered by ServiceM8. It is not offered or administered by Anthill Technologies / TradiesHelp.au or Richard McIntosh.
Purchasing training from us does not guarantee that ServiceM8 will approve your rebate claim.
Before purchasing training with the intention of claiming the ServiceM8 Setup & Training Rebate, you must read and understand ServiceM8's current Setup & Training Rebate Terms and Conditions.
By accepting these Terms, you acknowledge that you have been provided with the opportunity to read ServiceM8's rebate Terms and Conditions and that it is your responsibility to understand and comply with them.
ServiceM8 may change, withdraw or amend its rebate program and eligibility requirements. You should therefore check ServiceM8's current Terms before purchasing training and again before submitting your claim.

You acknowledge that ServiceM8's current Setup & Training Rebate conditions contain a 60-day requirement.
It is your responsibility to know the commencement date of your paid ServiceM8 subscription and the dates of the invoices being claimed and to ensure that all training, payment and claim requirements are completed within ServiceM8's applicable timeframe.
Where required by ServiceM8, you are responsible for submitting your paid Anthill Technologies / TradiesHelp.au invoice or invoices and any other required evidence.
You are responsible for:
Unless separately agreed in writing, Anthill Technologies / TradiesHelp.au and Richard McIntosh are not responsible for submitting your rebate claim or monitoring your rebate deadline.
Where your ServiceM8 setup and training is provided over more than one invoice, you are responsible for complying with ServiceM8's requirements concerning submission of those invoices.
ServiceM8's current conditions require all invoices being claimed to be submitted together as part of the claim, with the applicable services completed and paid.
Only one claim is currently permitted under the ServiceM8 rebate offer. It is your responsibility to ensure that your training schedule allows you to comply with ServiceM8's applicable claim deadline.
ServiceM8 alone determines whether a rebate claim is accepted and the amount and manner in which any account credit is applied.
If your rebate is:
this does not, by itself, cancel your training agreement with Anthill Technologies / TradiesHelp.au.
Failure to qualify for, claim or receive the ServiceM8 rebate does not provide grounds for a change-of-mind refund of training, setup or consulting fees paid to us.
During ServiceM8 setup, consulting or training, Anthill Technologies / TradiesHelp.au or Richard McIntosh may discuss, demonstrate, recommend, configure, integrate or refer you to third-party products, applications, software, hardware, integrations or service providers.
Any third-party product, app, integration, software, hardware, subscription or service that you choose to purchase, subscribe to, activate or use is separate from and outside this training agreement unless expressly agreed otherwise in writing.
Your decision to use a third-party product or service creates a separate relationship between you and that provider and may be subject to the provider's own prices, subscription arrangements, contracts, Terms and Conditions, privacy policies, cancellation provisions and refund policies.
Anthill Technologies / TradiesHelp.au and Richard McIntosh are not a party to any agreement between you and a third-party provider.
You are responsible for:
Where we assist you with setting up or integrating a third-party product, our involvement is limited to the agreed training or consulting assistance.
We do not guarantee the continued availability, compatibility, security, performance or functionality of third-party products or services.
A failure, outage, pricing change, subscription change, cancellation, discontinuation or other issue involving a third-party product or service does not, by itself, provide grounds for a refund of training or consulting fees paid to us.
Training and consulting are intended to assist you and your staff to configure, understand and use ServiceM8 effectively.
Results depend upon factors outside our control, including your participation, staff participation, implementation of recommendations, business procedures and ongoing use of ServiceM8.
We do not guarantee any particular:
Unless otherwise stated, original training materials, documentation, procedures and templates created by Anthill Technologies / TradiesHelp.au remain our intellectual property.
Materials provided as part of your training may be used internally within your own business.
Unless we provide prior written permission, our materials must not be commercially distributed, resold, republished, reproduced as another training product or supplied to third parties for commercial purposes.
ServiceM8's software, trademarks, documentation and other intellectual property remain the property of ServiceM8 or their respective owners.
During setup, consulting or training, you may provide us with access to business information or permit screen sharing or remote access to your systems.
Information made available to us will be used for the purpose of providing the agreed services.
You are responsible for ensuring that you have authority to provide access to the information, accounts and systems made available during training.
You should not provide passwords or access credentials unless reasonably required for the services being performed. Where temporary access is provided, you are responsible for changing or revoking access credentials when access is no longer required.
These Terms operate subject to the Australian Consumer Law.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where applicable, our services must be provided with due care and skill and comply with the consumer guarantees imposed by Australian law.
Our No Change-of-Mind Refund Policy applies where a Customer simply changes their mind, decides they do not like or no longer require the service, voluntarily discontinues training or seeks a refund in circumstances where there is no statutory entitlement to a refund or other remedy.
Nothing in these Terms removes any remedy to which you are legally entitled under the Australian Consumer Law.
To the maximum extent permitted by law, Anthill Technologies / TradiesHelp.au and Richard McIntosh are not responsible for indirect or consequential business losses arising from circumstances outside our reasonable control, including ServiceM8 outages, third-party software failures, internet or telecommunications failures, changes to ServiceM8 functionality, third-party integration failures, or actions or configuration changes subsequently made by the Customer or another person.
Nothing in this section excludes or limits liability where such liability cannot lawfully be excluded or limited.
This agreement is governed by the laws in force in New South Wales, Australia.
These Terms operate subject to the Australian Consumer Law and other applicable Commonwealth and New South Wales legislation.
The parties submit to the jurisdiction of the courts and tribunals of New South Wales, Australia, and courts having appellate jurisdiction from them.
To the extent permitted by law, disputes concerning these Terms or services supplied under them will be dealt with in New South Wales.
Anthill Technologies / TradiesHelp.au may update these Terms and Conditions from time to time.
The Terms applicable to a particular purchase are the Terms provided or made available to the Customer when that booking or purchase is made.
The version number and effective date at the beginning of this document identify this version of the Terms.
Before booking and paying for ServiceM8 setup or training, you must read these Terms and Conditions.
By accepting these Terms and proceeding with your booking and payment, you confirm that:

Your electronic acceptance, together with your booking and payment, constitutes your acceptance of these Terms and your intention to enter into a binding agreement with Anthill Technologies / TradiesHelp.au, ABN 67 869 707 435.
